General examination law
Examination procedures in general and digital examinations in particular are subject to strict statutory requirements, which mean that the scope for designing examinations is much narrower than for teaching.
Requirements for examinations in general
Admissibility
The chosen form of examination must be permitted in the examination procedure. This is regulated by the study and examination regulations as well as the general regulations of the university, e.g. a study framework regulation (at the HU: ZSP-HU).
Traceability
It must be possible to reconstruct the test procedure and the result at any time.
Protection against avoidance
There must be no formal or technical deficiencies in the examination procedure that could lead to a legal challenge of the examination results.
Equal treatment
The conditions of the examination procedure must be the same for all candidates (Art. 3 GG, equal opportunities). However, this does not include individual differences in competence, e.g. when using a computer or a poor level of written language.
Equivalence
Unabhängig davon, ob sie identisch sind oder sich voneinander unterscheiden, müssen alle Prüfungsfälle desselben Prüfungsverfahrens gleichwertig hinsichtlich Inhalt und Schwierigkeit sein.
Protection against deception
The possibility of candidates manipulating the examination procedure for personal gain must be minimised through suitable organisational and technical measures.
Assignability
It must be possible at all times to assign a test to a single test item without any doubt. It must also be possible to assign all examinations of an examinee to this examinee without any doubt.
Integrity
The immutability, integrity and completeness of the audit documents must be ensured. Protection against manipulation and loss of data and documents must be guaranteed.
Data protection
The personal data of examinees processed in the examination procedure (e.g. identifying data, examination behaviour, examination answers, examination results) must be protected against misuse by third parties and those involved in the procedure.
